Copyright and territoriality elements in Malta

Identifying the country of protection and where the infringement occurred is the starting point when engaging in international copyright litigation. Reflecting other Intellectual Property Rights, Malta's law on copyright is based on the principle of territoriality, whereby once created, they do not give automatically rights in all other countries but rights are limited to when the legal requirements for protection are satisfied.

At the forefront of discussing the relationship between territoriality and copyright in Malta, a distinction must be made between limitation of territoriality and territoriality of conflict of laws. The former principle provides that the scope of intellectual property rights is limited to the territory for which they have been granted.
