The Bolar Provision was established within the United States as a result of the Roche Products v Bolar Pharmaceutical judgement. Malta’s has taken a pro-active approach within this industry and has implemented the Bolar Provision during 2003. This has served to position Malta as a jurisdiction of choice for pharmaceutical companies, and this is reflected in the high number of pharmaceutical companies relocating to Malta on an annual basis.
